ELIGIBILITY

No purchase is necessary to enter or win. Entry in this contest constitutes acceptance of the official rules and regulations as outlined below. Void where prohibited by law.

Employees, independent contractors, officers, and directors of Destination Osoyoos and its affiliates and subsidiaries and their immediate family members (spouse/domestic partner, parents, children, siblings and their respective spouses) and those living in the same household of each (whether legally related or not) are not eligible to enter or win.

Must be 19 years of age or older to enter.

Contest will run during the following times:
May 1st, 2022 until July 4th, 2022

After each contest period, the winner will be notified via the email provided, or by direct message on Instagram.

Enter by: Uploading your pics through the Uploader on the official contest page through the Destination Osoyoos website with photo submission.

Please note the following restrictions for the prize:

The total approximate retail value (“ARV”) for the prize is $600 CDN Dollars as of date of printing of these Official Rules. The difference in value of Prize as stated herein and value at time of prize notification, if any, will not be awarded.

Prizes do not include any other item or expense not specifically described in these Official Rules & Regulations, including gratuities, and all additional expenses including, without limitation, other travel expenses, if any, are the sole responsibility of winner. Only listed prizes will be awarded and no substitutions or cash equivalents or redemption will be made. The winner agrees to accept the prize “as is”, and entrants hereby acknowledges that Destination Osoyoos has neither made nor is in any manner responsible for liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to prize, including express warranties (if any) provided exclusively by a prize supplier that are sent along with the prize. Prize travel is subject to space availability at time of booking and minimum reservations requirements may apply. Other conditions may apply.


SELECTION OF WINNER
The winner of each prize will be selected randomly by Destination Osoyoos, whose decision on all matters relating to drawing and winner are final and binding. The Prize will be awarded at random from all eligible entries received. Destination Osoyoos reserves the right to disqualify any participant or winner and may refuse to award the prize to a person who is ineligible or has violated any rule, gained an unfair advantage in participating in the Contest or obtained winner status using fraudulent means. The odds of winning depend on the number of eligible entries received. The winner will be notified via email or phone number provided, no more than 24 hours after the weekly contest draw date.

If the selected winner does not respond within 24 hours of notification, they will be disqualified, and another eligible entrant may be selected by random draw as a potential prize winner until such time as an entrant satisfied the terms set out herein and the prize is awarded.

Publicity, Privacy & Prize Notification: Except where prohibited by law or regulation, by submitting an entry, entrant grants Destination Osoyoos a perpetual, royalty-free license to use his/her name, photograph, voice, and likeness in connection with the promotion of this and other Sweepstakes, and entrants waive any and all claims and/or rights to receive any royalties or other compensation for Destination Osoyoos’ use thereof, unless prohibited by law. Entrants’ information that Destination Osoyoos collects will not be disclosed to third parties.

Entrants that do not win will not be notified.

General Conditions: The submission of an entry is solely the responsibility of the entrant. Only eligible entries received within each Entry Period will be included in the prize drawings. Destination Osoyoos retains the right, in its absolute and sole discretion, to make substitutions of equivalent kind or approximate value in the event of the unavailability of any prize or component of the prize for any reason whatsoever.

This contest is subject to all federal, provincial and municipal laws. This contest and all affiliated businesses, entries, and entrants are not sponsored, endorsed or administered by, or associated with Instagram.

Limitation to Liability & Release: By participating in the Destination Osoyoos Sweepstakes entrants agree to indemnify and hold harmless Destination Osoyoos, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees (collectively “Releases”) from and against any and all injuries, losses, damages, claims, and actions of any kind arising from or relating to participation in the Contest, or acceptance, possession, use, misuse, or non-use of the prize that may be awarded, including, without limitation, actual, direct, indirect, consequential, punitive, special, or other damages.

Photo Submission and Hashtag Usage:

By submitting a photo(s) via the online uploader, you agree to give permission to Destination Osoyoos to use the photo(s) for any purpose, including but not limited to: promotional materials, publications, displays, website, social media channels without compensation to the photographer or any individuals or anything in the photo(s). Photo credit will be given where possible.

By submitting a photo(s), you agree that any person(s) in the photo(s) have provided their consent in allowing their picture to be entered into the Destination Osoyoos’ photo contest. Failure to obtain such consent will deem the entry ineligible.

By submitting a photo(s), you agree that you own all copyrights in the photograph. You represent and warrant that photographs have not been copied in whole or in part from any other work, do not violate or infringe any copyright, moral right, trademark or other proprietary right of any person or entity, and are, together with the copyright and moral rights therein, the sole and exclusive property of the entrant.

By submitting a photo(s), you agree to allow the photo(s) to be posted on the Destination Osoyoos website and for Destination Osoyoos to add such functionality that allows users to rate, leave comments, and provide any other feedback to the submitted photo(s). Destination Osoyoos is NOT responsible for photos being reposted to third party websites and social media services, such as Facebook or Twitter.
